PALMETTO PASS LICENSE AGREEMENT Adopted January 1, 2013
Subject to the terms of this Palmetto Pass License Agreement (“Agreement”), Connector 2000 Association, Inc. (“we”, “us” or “our”) licenses to you the right to use the issued Palmetto Pass automatic payment transponder(s) (“Pal Pass” or “tag”) on the Southern Connector toll road, located in Greenville, South Carolina (the “Southern Connector”) and as otherwise provided in this Agreement. Purchase of a Pal Pass or use of your Pal Pass constitutes acceptance of and your agreement to be bound by the terms of this Agreement.
1. Current Account Holders. If you have an account that was opened prior to January 1, 2023 you remain responsible under the terms of our prior License Agreement dated January 1, 2012 UNTIL such time as you receive notice of the new terms in accordance with the prior License Agreement and any Pal Pass associated with your account and issued prior to January 1, 2023 is used or replaced or any additional Pal Passes are issued to you. Upon such use of your Pal Pass, replacing a Pal Pass or receiving a newly issued Pal Pass, you shall be deemed to be bound by and responsible for compliance with the terms of this Agreement from that point forward in replacement of the obligations under the License Agreement dated January 1, 2012.
2. Vehicle Use. You agree to use your Pal Pass only in the vehicle specifically assigned to that Pal Pass. If more than one Pal Pass is connected to your Pal Pass account, you agree to use your Pal Passes only in the vehicles listed in your account. You must display and use your Pal Pass according to our instructions. It is a violation of South Carolina law to affix your Pal Pass in a manner that obstructs the driver’s clear view of the highway or any intersecting highway. [See S.C. Code Ann. Section 56-5-5000].
3. Pal Pass Use. Subject to Section 4 of this Agreement, you may use your Pal Pass in all open toll lanes on the Southern Connector. You may not travel through a staffed or automatic coin machine (“ACM”) toll lane until the toll signal turns green or yellow. If the signal does not turn green or yellow, you must pay the applicable toll in cash before you pass through the toll lane. You must comply with all applicable traffic laws, regulations, signs and signals and the directions of toll collectors and law enforcement officers. When using a staffed or ACM lane you are required to come to a complete stop. Failure to adhere to any of these requirements may result in you being charged with a toll violation in accordance with law, and charged with an administrative fee of up to $25 per violation, plus any required toll, court costs, attorney’s fees, and possible civil penalties, closure of your Pal Pass account, suspension of vehicle registration, and/or garnishment of your tax refund and/or your wages.
4. Tags. Pal Pass tags may only be used on the Southern Connector. Other automatic payment transponders, such as EZPass, SunPass, and IPass, are NOT accepted on the Southern Connector. The tag MUST be mounted in accordance with the mounting instructions provided with your tag. You must purchase replacement tags for any tags lost, stolen or damaged by improper mounting, improper care or other abuse. When you sell or otherwise dispose of your vehicle, please remember to remove the tag from the windshield and dispose of it. Once removed, your tag will no longer function. If sufficient funds are available, we will debit, from your account, the purchase price of each replacement tag issued to you.
5. Tag Purchase. You must purchase a tag for each vehicle registered to your account. You may purchase tags at the then current price and no monies will be refunded for returning a used tag. (See the FAQ section at www.southernconnector.com for current tag cost). You may purchase up to 5 tags at any time on-line via our website (www.southernconnector.com). If you would like to place an order for more than 5 tags at one time, you must contact our Customer Service Center. All tag sales are final.
6. Opening/Maintaining Your Account. A minimum of $40 in prepaid tolls is required to open your Pal Pass account. Each time you drive through a Pal Pass lane, we will deduct the applicable toll from your account. You may maintain your account as a Credit Card User, by providing us with credit card information, or as a Cash User by opening and increasing your account balance by check or money order.
7. Minimum Usage Fees. There are NO minimum usage fees.
8. Reporting to Credit Bureaus. We reserve the right to report any delinquent accounts to an authorized credit bureau.
9. Itemized Statements. Upon request only, we will mail you a quarterly statement, free of charge, showing the transactions affecting your account during the preceding 3 months. You can print statements any time at www.southernconnector.com. We do NOT supply credit card charge receipts.
10. Account Information.
11. Lost or Stolen Pal Pass. If your Pal Pass is lost or stolen, you must notify the Customer Service Center immediately so we may invalidate the tag. Until you notify us that your Pal Pass is lost or stolen, we may continue to deduct from the account tolls, fees and administrative fines incurred through the use of your Pal Pass. Also, we may continue to charge your credit card as provided in this Agreement. We will issue you a new Pal Pass tag, subject to you paying the then current purchase price for a replacement tag.
12. Termination of License. We may terminate your Pal Pass account and your license under this Agreement at any time. You may terminate your Pal Pass account and your license under this Agreement at any time by notifying us of your desire to terminate your account by phone or certified mail to our Customer Service Center. Any remaining prepaid toll balance in your account after payment of any monies owed to us will be refunded to you by check.
13. Inactive Accounts. If you have not used the Southern Connector (as determined by your account debit history) for a period of two (2) years, we may terminate your account and license under this Agreement. If we terminate your account, we will notify you of your account’s termination at the last address associated with your account and return the balance of your account to you, if possible. If, after one-hundred and twenty (120) days of such notification, a balance remains in your account, that balance may become abandoned property subject to being escheated to the State of South Carolina in accordance with the provisions of the South Carolina Uniform Unclaimed Property Act.
